The Song Remains The Same
A lot of people are trying to say that it's a different world today, and that eavesdropping on a massive scale is not covered under the FISA statute, because it just wasn't possible or anticipated back then. That's a lie. Project Shamrock began in the 1950s, and ran for about twenty years. It too had a massive program to eavesdrop on all international telegram communications, including communications to and from American citizens. It too was to counter a terrorist threat inside the United States. It too was secret, and illegal. It is exactly, by name, the sort of program that the FISA process was supposed to get under control ... Bush's eavesdropping program was explicitly anticipated in 1978, and made illegal by FISA. There might not have been fax machines, or e-mail, or the Internet, but the NSA did the exact same thing with telegrams.

The executive branch shall construe Title X in Division A of the Act, relating to detainees, in a manner consistent with the constitutional authority of the President to supervise the unitary executive branch and as Commander in Chief and consistent with the constitutional limitations on the judicial power, which will assist in achieving the shared objective of the Congress and the President, evidenced in Title X, of protecting the American people from further terrorist attacks.

Translation: I reserve the constitutional right to waterboard when it will "assist" in protecting the American people from terrorist attacks. [UPDATE: Or, as Matthew Franck eagerly puts it over at the National Review, "the signing statement . . . conveys the good news that the president is not taking the McCain amendment lying down."]

If this were a dictatorship, it would be a heck of a lot easier - just so long I'm the dictator.

I listen not to sympathy
Whilst ruler of this land
Withdraw your feeble aches and moans
Or suffer smite from this my hand
(Tyrant) Capture of humanity
(Tyrant) Conqueror of 'em all
(Tyrant) Hideous destructor
(Tyrant) Every man shall fall
Mourn for us oppressed in fear
Chained and shackled we are bound
Freedom choked in dread we live
Since Tyrant was enthroned
